Destination Wedding Paperwork 101: What Couples Need

The dress gets six months of attention. The paperwork gets six days. Then someone realizes the marriage license, the translated documents, and the notarization each run on their own timeline — and those timelines do not line up.

The good news, if you are marrying in Florida, is that this state makes it genuinely easy. The requirements are clear, the waiting rules are more generous than most couples expect, and the list of people who can legally marry you is unusually broad. Here is the whole thing in plain English, in the order you actually need it.

The Florida License Is Simpler Than You Think

There is no residency requirement and no citizenship requirement. Any couple of legal age can apply at any Clerk of the Circuit Court office in the state, and the license is valid statewide — the county that issues it does not have to be the county you marry in.

Both of you must appear together in person. There is no proxy and no remote application in the standard process. You will each need valid government-issued photo identification, and you will be asked for a Social Security number if you have one; applicants without an SSN can generally satisfy the requirement with an alien registration number or other acceptable identification.

The license fee sits in the mid-eighties in most counties, with a meaningful discount for couples who complete a state-approved premarital preparation course. Fees and procedures are set county by county, so confirm with the specific clerk’s office you plan to use.

Once issued, the license is valid for sixty days. The ceremony has to happen inside that window. This is the deadline that catches couples who apply too early because they wanted the errand out of the way.

The Waiting Period That Only Applies to Some of You

This is the single most misunderstood rule in Florida wedding planning.

Florida residents face a three-day waiting period between issuance and when the license takes effect — unless they complete a state-approved premarital preparation course, which waives the wait and reduces the fee at the same time. Non-Florida residents are statutorily exempt from that waiting period altogether, which is one of the main reasons Florida is a leading destination-wedding state. A couple flying in can, in principle, apply and marry the same day.

One practical warning from the field: clerk offices vary in how proactively they apply the non-resident exemption. Some apply it automatically. Others impose the three-day delay unless you say something. Tell the counter clearly that you are non-residents and ask for the exception to be applied. It takes one sentence and it has saved more than one couple’s timeline.

Who Can Actually Marry You

Florida law is unusually flexible here. Ordained clergy, all judicial officers, clerks of the circuit court, and — distinctively — notaries public are all authorized to solemnize a marriage in Florida. There is no separate “wedding officiant license” in this state.

That notary provision matters more than it sounds. Florida is one of only a handful of states that authorizes a notary public to perform a legally binding wedding, and it is the reason a South Florida couple can have one professional handle both the ceremony and the documents around it.

Whoever officiates, the ceremony has to take place in Florida, and afterward the officiant completes and signs the certificate portion of the license and returns it to the issuing clerk within ten days. A certified copy comes back to you once it is recorded. The marriage becomes official through the paperwork, not the vows — which is worth remembering when you are choosing who handles that final step.

Where Notarization Actually Enters the Picture

The license itself does not need to be notarized. Almost everything around it might.

Couples marrying abroad are frequently asked for a single-status or no-impediment affidavit, notarized and often apostilled, before a foreign registrar will proceed. Couples marrying here with documents issued elsewhere may need a certified translation accompanied by a notarized translator’s affidavit. Prenuptial agreements carry their own execution requirements. And after the wedding, name-change paperwork across banks, employers, and agencies generates its own stack.
